A 58-year-old man shot and killed his 61-year-old brother on March 7 after the older brother assaulted their 80-year-old mother, striking her with a bat and choking the elderly woman, police said.
The shooting occurred around 1:25 p.m. in the 400 block of North Alfred Street in the Beverly Grove area. The Los Angeles Police Department received multiple calls about shots fired and officers from the Wilshire Division were dispatched to the scene. The man who shot his brother was detained and questioned, but not arrested. Police said it was a justifiable homicide and the man will not face charges.
Investigators believe the deceased man was suffering from mental health issues and was armed with a baseball bat when he arrived at the residence on Alfred Street. The man smashed a window, entered the residence and began damaging property, police said. He also threatened to kill his mother.
The family owns a nearby business and the elderly woman called her younger son for help. He arrived minutes later with a shotgun and saw the older brother through a glass door, choking their mother on the ground, police said. He fired a warning shot and then shot the man once, killing him.
“In his mind, he had no other choice but to shoot his brother,” said Detective Sam Marullo, with the LAPD’s West Bureau Homicide Unit.
Marullo said the deceased man periodically stayed at the residence. Investigators learned there had been problems between the man and other family members in the past. The Los Angeles County Department of Medical Examiner identified the decedent as Robert Shrier.
Marullo did not disclose the name of the family’s business. The female victim survived the attack and is recovering.
“It’s very tragic,” Marullo added. “It’s horrible for everybody.”
