RE “Metro awards bid for Phase 3 of subway,” July 5 issue
I read your article and thank you for your reporting of the award of the Purple Line 3 tunnels to Tutor Perini and its wholly-owned subsidiary, Frontier-Kemper. I would, however, like to correct one factual error for the record.
On page 26 of the paper, you speak to a legal battle with Metro in the late 1990s, frankly all the way into 2016. For your information, the early award that you refer to of $29 million was in fact reversed under appeal with very long language speaking to the misconduct of the judge who made that initial award. Once it was reversed, we retried the case against the Los Angeles MTA and won an award of approximately $6 million, which we have been paid and settled with no appeals.
I think it is important that the record be accurate that they never won the case. We, in fact, did and were paid the money.
